- As used in this chapter:

(a) “Ambient temperature” means the temperature surrounding an animal.

(b) “Breeder” means any owner or keeper of a kennel who breeds more than 2 litters of dogs annually

(c) “Commissioner” means the Commissioner of the Virgin Islands Department of Agriculture or the Commissioner’s authorized representative.

(d) “Companion animal” means a domesticated animal that serves as a companion in the home of its owner.

(e) “Commissioner of Licensing” means the Commissioner of the Department of Licensing and Consumer Affairs or the Commissioner’s authorized representative.

(f) “Department” means the Virgin Islands Department of Agriculture.

(g) “Housing facility” means a room, building, or area used to contain a primary enclosure or enclosures.

(h) “Incompetence” means the demonstrated incapability of a person to understand the requirements of this chapter by failure or refusal to conform to such requirements for the care and handling of dogs and cats.

(i) “Kennel” means a housing facility where animals are kept for the purpose of boarding, breeding, work, resale rescue, or temporary holding.

(j) “Primary enclosure” means a structure used to immediately restrict one or more animals to a limited amount of space, such as a room, pen, run, cage, or compartment.

(k) “Registrant” means an animal shelter licensed and registered pursuant to this chapter.

(l) “Sanitize” means to make physically clean and to remove and destroy, to a practical minimum, agents injurious to health.

(m) “Standards” means Standards of Care published by the Association of Shelter Veterinarians.
