Sec. 0.01.
Short title.
This Act may be cited as the
Environmental Protection Trust Fund Act.

Sec. 1.

There is hereby created the Environmental Protection Trust Fund
Commission to be composed of the following ex officio members: the Attorney
General, the Director of Natural Resources,
the Chairman of the Pollution Control Board, and the Director
of the Environmental Protection Agency. Each member may designate a proxy
to act in his stead. The Commission shall elect from its number a chairman
and a majority of the Commissioners shall constitute a quorum for the conduct
of business, the affirmative votes of at least 3 members being necessary
for any action. Members of the Commission shall serve without compensation.

The Commission may accept, receive and administer on behalf of the State
any grants, gifts, loans, or other funds made available to the Commission
from any source for purposes of environmental protection and related
enforcement programs. Any such funds received by the Commission under this
Section shall be appropriated by the General Assembly, and shall be deposited
in a trust fund designated as the Environmental Protection Trust Fund with the
State Treasurer and held and disbursed by the State Treasurer in accordance
with “An Act in relation to the receipt, custody, and disbursement of money
allotted by the United States of America or any Agency thereof for the use
in this State”, approved July 3, 1939, as amended, provided that such monies
shall be used only for the purposes for which they are contributed and any
balance remaining shall be returned to the contributor, and provided further
that such monies received from the United States of America or any Agency
thereof may be used only if first appropriated by the General Assembly.

The Commission has the authority to approve grants from the Environmental
Protection Trust Fund to the Office of the Attorney General, the Environmental
Protection Agency, the Pollution Control Board or the Department of Natural
Resources in order to carry out the provisions
of this Section.
