  1. It is unlawful for any person other than an employee of the department to perform commercial driver’s license driving tests, to act as a commercial driver’s license testing unit, or to act as a commercial driver’s license driving tester unless such person has been duly licensed by the department under the provisions of section 42-2-407.
  2. [ Editor’s note: This version of subsection (2) is effective until March 1, 2022.] Any person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not less than twenty-five dollars nor more than one thousand dollars, or by imprisonment in the county jail for not more than one year, or by both such fine and imprisonment.

    (2) [ Editor’s note: This version of subsection (2) is effective March 1, 2022. ] Any person who violates the provisions of this section commits a petty offense and, upon conviction thereof, shall be punished as provided in section 18-1.3-503.
