  • (a) An individual, otherwise eligible to participate in the Program, must, prior to receiving any benefit from the Program, file with the Commissioner a written, signed application to participate in the Program. Such applications shall be on forms provided for that purpose by the Commissioner and shall contain such information as the Commissioner deems necessary to make determinations regarding eligibility. Each such application shall be accompanied by: (i) a signed statement authorizing the Commissioner to verify information contained in such application from any source; and (ii) a color or black and white photograph of the person submitting the application.

  • (b) The Commissioner shall, no later than thirty (30) days from the date a written application is filed under subsection (a) of this section:

    • (i) make a determination on the eligibility of the applicant to participate in the Program;

    • (ii) certify whether such applicant may participate in the Program; and

    • (iii) notify the applicant in writing of such determination; provided, that in all cases where an individual has been determined ineligible to participate in the Program, such written notice shall specify the grounds for such determination.

  • (c) The Commissioner shall, in each case where an applicant has been certified to participate in the Program and within the time specified in subsection (b) of this section, mail or otherwise make available to the certified applicant an identification card containing the name, address and photograph of the certified applicant, an identification number, the date on which the card shall expire, and notification that the card is for the purpose of the Pharmaceutical Assistance to the Aged Program.
