  • (a) Unless expressly continued by provisions of this Code, and except as otherwise provided herein, no general, local, or colonial law, ordinance, decree, order, placard, or regulation which prior to the effective date of this Code was applicable in the Virgin Islands or any part thereof, and which, prior to the acquisition of the Virgin Islands by the United States of America, was issued, promulgated, proclaimed, or enacted by the King or State of Denmark, or by any local or other legislative or administrative body, or officer acting under the authority of the King or laws of Denmark, has any force or effect in the Virgin Islands. However, this section does not affect any right acquired, or liability incurred, under any such law, ordinance, decree, order, placard, or regulation prior to the effective date of this Code, and existing on that date.

  • (b) Subsection (a) of this section shall not be construed as affecting the “Law concerning Custom House and Ship Dues in St. Thomas and St. Jan” (No. 64–1914), passed by the Diet and sanctioned by the King of Denmark on April 1, 1914, as amended, or the “Ordinance concerning Custom House and Ship Dues in St. Thomas and St. Jan”, passed by the Colonial Council and sanctioned by the King of Denmark on August 6, 1914, as amended, insofar as the provisions of such Law and Ordinances may still be in effect under section 36 of the Act of Congress of June 22, 1936 (48 U.S.C. § 1406i).
