The provisions of this chapter shall not apply to any remote service terminal which is located:
- Inside a building, unless it is a freestanding installation which exists for the sole purpose of providing an enclosure for the remote service terminal;
- Inside a building, except to the extent a transaction can be conducted from outside the building; or
- In any area, including any access area, building, enclosed space, or parking area, which is not controlled by the operator.
