§ 97-i. New York state local government records management improvement fund. 1. There is hereby established in the joint custody of the state comptroller and the commissioner of taxation and finance a special fund to be known as the New York state local government records management improvement fund.

2. Such fund shall consist of revenues derived from the imposition of the additional fee authorized pursuant to the third undesignated paragraph of subdivision (a) of section eight thousand eighteen, subparagraph b of paragraph four of subdivision (a) of section eight thousand twenty-one, subparagraph b of paragraph eleven of subdivision (b) of section eight thousand twenty-one of the civil practice law and rules, and subdivision one of section 7-614 of the administrative code of the city of New York, all monies required by section 57.35 of the arts and cultural affairs law to be paid into or credited to the fund, any advances hereafter made by the state to the fund in anticipation of being reimbursed by such fund, and any other monies credited or transferred thereto from any other fund or sources pursuant to law.

3. The monies in such fund, when allocated, shall be available as follows: (i) two million three hundred thousand dollars per year adjusted annually to reflect the direct and indirect charges resulting from negotiated salary increases may be used for payment of necessary and reasonable expenses incurred by the commissioner of education in carrying out the advisory services required in subdivision one of section 57.23 of the arts and cultural affairs law and to implement sections 57.21, 57.35 and 57.37 of the arts and cultural affairs law; (ii) not less than five hundred thousand dollars per year shall be made available to the Documentary Heritage program as provided in section 140 of the education law; (iii) not less than three hundred thousand dollars per year shall be made available to the New York state archives partnership trust established in chapter 758 of the laws of 1992; and (iv) the remainder of the monies in the fund shall be used for the award of grants to individual local governments or groups of cooperating local governments as provided in section 57.35 of the arts and cultural affairs law.

4. Monies shall be payable from the fund on the audit and warrant of the comptroller on vouchers approved by the commissioner of education or by an officer or employee of the commissioner of education designated by the commissioner of education.
