The provisions of this subchapter shall not apply to goods or services contracted for upon public or private advertised bids.

All fees, civil penalties, or payments of any type collected by the Commission on Water Well Construction under this chapter shall be deposited into one (1) or more banks qualifying for the deposit of public funds to be used by the commission for the proper administration of this chapter.
