Section 431A.870 – Duty of pharmacist to fill prescription.

A pharmacist may not refuse to fill a valid prescription solely because the pharmacist cannot receive patient information from the prescription monitoring program established under ORS 431A.855 at the time the patient requests that the prescription be filled. [Formerly 431.968]

Section 431A.875 – Reports to health professional regulatory boards.

If a practitioner or pharmacist authorized to obtain prescription information from the electronic system established under ORS 431A.855 discloses or uses information obtained from the electronic system in violation of ORS 431A.865, the Oregon Health Authority shall report the individual to the appropriate health professional regulatory board.
