Section 16-3A-02 – Vending Machines

    A person may not sell or dispense or offer to sell or dispense a tobacco product through a vending machine in the State, unless the vending machine is located in an establishment that individuals under the age of 21 years are prohibited by law from entering at any time.

Section 16-3B-01 – Violating Regulation of Executive Director

    (a)    A person may not violate a regulation adopted by the Executive Director that applies to a person who sells cigarettes at retail.     (b)    A person who violates this section is guilty of a misdemeanor and, on conviction, is subject to a fine of $100.
