(a) In Part II of this subtitle the following words have the meanings indicated. (b) “Console machine license” means a license issued by the clerk to keep a free-play console machine for public use. (c) “Pinball machine license” means a license issued by the clerk to keep a free-play pinball machine for public use.
(a) Except as provided in subsection (b) of this section, Part II of this subtitle applies only in Baltimore City and Baltimore, Caroline, Dorchester, Harford, Kent, Montgomery, Queen Anne’s, and Talbot counties. (b) In Montgomery County, Part II of this subtitle does not apply to free-play console machines.
The Mayor and City Council of Baltimore may license free-play pinball machines and free-play console machines under Chapter 27 of the Acts of 1951 and the ordinances implementing that chapter.
Notwithstanding any other law, it is lawful to keep and operate a free-play pinball machine or free-play console machine and to award free games to players if the free-play pinball machine or free-play console machine is licensed under Part II of this subtitle.
(a) Whenever a person keeps a free-play pinball machine for public use in the State, the person must have a pinball machine license for that free-play pinball machine. (b) Whenever a person keeps a free-play console machine for public use in the State, the person must have a console machine license for that free-play console machine.
(a) (1) An applicant for a pinball machine license shall pay to the clerk a license fee of: (i) $10 for each free-play pinball machine in Caroline County, Kent County, or Queen Anne’s County; or (ii) $20 for each free-play pinball machine in Baltimore City, Baltimore County, Dorchester County, Harford County, Montgomery County, or Talbot County. (a) For each free-play pinball machine or free-play console machine licensed under Part II of this subtitle, the clerk shall issue a certificate that the license fee for the current year has been paid. (b) The certificate shall be attached to the free-play pinball machine or free-play console machine.
(a) A pinball machine license may be transferred to another free-play pinball machine. (b) A console machine license may be transferred to another free-play console machine.
(a) A person may not keep a free-play pinball machine for public use in the State unless the person has a pinball machine license that covers that free-play pinball machine. A free-play pinball machine or free-play console machine may not pay out cash or tokens.
A person who keeps a free-play pinball machine or free-play console machine for public use may not allow a minor to operate the free-play pinball machine or free-play console machine.
(a) Except as otherwise provided in this section, a person who violates Part II of this subtitle is guilty of a misdemeanor and, on conviction, is subject to a fine not exceeding $100 for each violation.
