Section 17-420 – “Wicomico County Pinball Machine License” Defined
In Part III of this subtitle, “Wicomico County pinball machine license” means a license issued by the clerk to keep a pinball machine for public use in Wicomico County.
Section 17-421 – Scope of Part
Part III of this subtitle applies only in Wicomico County.
Section 17-422 – Licensing Certain Machines Prohibited; Licensing Pinball Machines Authorized
(a) Free-play console machines and free-play pinball machines may not be licensed or kept for public use in Wicomico County. (b) Pinball machines may be licensed under Part III of this subtitle and kept for public use in Wicomico County if they: (1) are amusement devices only; and (2) are not free-play console machines or free-play pinball machines.
Section 17-423 – License Required
Whenever a person keeps a pinball machine for public use in Wicomico County, the person must have a Wicomico County pinball machine license for that pinball machine.
Section 17-424 – License Fees; Disposition of Money
(a) An applicant for a Wicomico County pinball machine license shall pay to the clerk a license fee of $20 for each pinball machine. (b) The license fee shall be prorated monthly. (c) All money collected under Part III of this subtitle shall be paid into the general fund of Wicomico County.
Section 17-425 – Issuance and Display of Certificate
(a) For each pinball machine licensed under Part III of this subtitle, the clerk shall issue a certificate that the license fee for the current year has been paid. (b) The certificate shall be attached to the pinball machine.
Section 17-426 – Transferability of License
A Wicomico County pinball machine license may be transferred to another pinball machine of the same type.
Section 17-427 – Keeping Machine Without License
A person may not keep a pinball machine for public use in Wicomico County unless the person has a Wicomico County pinball machine license that covers that pinball machine.
Section 17-428 – Operation by Minors Prohibited
A person who keeps a pinball machine for public use in Wicomico County may not allow a minor to operate the pinball machine.
Section 17-429 – Penalty
A person who violates Part III of this subtitle is guilty of a misdemeanor and, on conviction, is subject to a fine not exceeding $100 for each offense.
