Section 21-501 – Short Title
This title may be cited as the “Maryland Environmental Health Specialists Act”.
Section 21-502 – Termination of Title
Subject to the evaluation and reestablishment provisions of the Program Evaluation Act, the provisions of this title and of any rule or regulation adopted under this title shall terminate and be of no effect after July 1, 2027.
Section 20-403 – Fraudulent Certificates
A person may not: (1) Sell or fraudulently obtain or furnish or aid in selling or fraudulently obtaining or furnishing a certificate issued under this title; or (2) Perform the duties of a program administrator or residential child and youth care practitioner under any certificate unlawfully or fraudulently obtained or issued.
Section 21-304 – Examinations
(a) An applicant who otherwise qualifies for licensure is entitled to be examined as provided in this section. Section 20-404 – Operation of Program in Absence of Administrator Prohibited; Exception
Except when a program administrator is removed from the position by death or for any other unexpected cause as provided in § 20-301 of this title, a program may not be operated unless it is under the day-to-day management and operation of a certified program administrator.
Section 21-305 – Regulations Establishing Environmental Health Specialist-in-Training Program

Section 20-405 – Penalties
A person who violates any provision of this title is guilty of a misdemeanor and on conviction is subject to: (1) A fine not exceeding $1,000 for a first offense; and (2) A fine not exceeding $5,000 or imprisonment not exceeding 6 months or both for any subsequent violation of the same provision.
Section 21-306 – Waiver of Examination of Persons Registered in Other State
(a) Subject to subsection (b) of this section, the Board may waive any examination requirement of this title for an applicant who is licensed or registered as an environmental health specialist or its equivalent in another state.
